This agreement is a revised version of LOMI's "Usage Agreement", which will be announced on August 13, 2024.

1. Accept the terms

  • 1.1 The operators of LOMI and related affiliates (hereinafter referred to as "LOMI") provide you with LOMI-based (including LOMI PC client, LOMI and LOMI-related clients, mobile web clients, etc.) in accordance with the terms of this use agreement and the rules published from time to time. The terms of this agreement may be modified by LOMI at any time, and the revised usage agreement will effectively replace the original usage agreement once it is published on the website. 2. Service description

  • 2.1 The user understands and agrees that LOMI’s services, products and materials are only provided in their current status, and LOMI expressly refuses to give any express or implied warranty or guarantee for “services”, “data” or “products”. Warranties, including but not limited to guarantees or guarantees for commercial use, fitness for a particular purpose, or non-infringement of the rights of others. LOMI is not responsible for any direct, indirect, incidental or consequential derivative losses arising from "services", "products" or "data". LOMI assumes no responsibility for the timeliness, deletion, misdelivery, failure to store or any other problems with any user information or personalized settings.

  • 2.2 You agree that LOMI has the right to formulate general measures and restrictions regarding the use of this service, including but not limited to the maximum period for which the service will retain posted content or other published content, and the upper limit of the number of times you can use the service within a certain period (and /or maximum time limit for each use). You agree that LOMI has no responsibility if any messages, communications and other content posted or transmitted through the Service are deleted or not stored. You also agree that LOMI reserves the right to change these general measures and restrictions at any time, at its sole discretion, with or without notice.

3. Your registration obligations

4. User account, password and security

  • 4.1 After completing the registration process for this service and successfully registering, you can use your registered email/mobile phone number and password to log in to your LOMI account (hereinafter referred to as the "Account").   • 4.2 You are fully responsible for all actions that occur using your account. do you agree:

    1) If your LOMI account is used without authorization or any other security issues occur, you will notify LOMI immediately;

    2) If you fail to keep your account and password safe, LOMI does not assume any responsibility for any loss or damage caused;

    3) You are fully responsible for any damage caused to you, LOMI or a third party by using your account, including if you fail to keep your account or password safe.

  • 4.3 Since the user's personal information can be obtained through the account, and the ownership of the account belongs to LOMI, unless expressly provided by law, the user may not transfer, sell or lend the account to others without the consent of LOMI.

  • 4.4 If you have not logged into the LOMI platform for six consecutive months and there is no unexpired valid business, LOMI has the right to restrict your use of your account. You shall be solely responsible for any adverse consequences caused thereby.

  • 4.5 If you choose to bind your LOMI account with a third-party account, in addition to unbinding it yourself, if any of the following circumstances occurs, your bound third-party account may also be unbound and LOMI does not need to do anything about it. You or any third party shall have no liability for:

    1) You violate laws, regulations, national policies or this Agreement;

    2) You violate the third-party account user agreement or its relevant provisions;

    3) Other situations that require unbinding.

5. Protection of user personal information

  • 5.1 Protecting the security of your personal information is not only a legal requirement, but also a basic principle that LOMI has long adhered to. LOMI will process your personal information in accordance with the provisions of this Agreement.

  • 5.2 Under normal circumstances, you can browse and modify your information on LOMI at any time, but for security and identification reasons, you may not be able to modify the initial registration information and other verification information provided during registration.

6. Responsibility of provider

You expressly understand and agree that LOMI shall not be liable for any direct, indirect, incidental, special, derivative or punitive damages arising from the following reasons, including but not limited to economic, reputation, data loss or other intangible losses:

1) The use or inability to use this service;

2) Costs incurred to replace any goods, data, information, services purchased or obtained from or through this service, messages received, or transactions concluded with third parties;

3) Your transmission or data is subject to unauthorized access or alteration;

4) Statements or actions made by any third party in this service;

5) Third parties publish or deliver fraudulent information in any way, or induce users to suffer financial losses;

6) Other matters related to this service, except as expressly provided in this usage agreement.

7. Service changes, interruptions or terminations

  • 7.1 LOMI may change the service content, interrupt or terminate the service.

  • 7.2 In view of the particularity of network services (including but not limited to server stability issues, malicious network attacks and other behaviors or circumstances beyond LOMI's control), you agree that LOMI has the right to interrupt or terminate part or all of the service at any time.

  • 7.3 You understand that LOMI needs to regularly or irregularly maintain, upgrade or suspend part or all of the service on the platform or related equipment that provides the service. If the service is interrupted within a reasonable period of time due to such circumstances, LOMI is not responsible for this. any liability.

  • 7.4 If any of the following circumstances occurs, LOMI has the right to interrupt or terminate the provision of services under this Agreement to you at any time without liability to you or any third party:

    1) The personal information you provide is untrue;

    2) You violate laws, policies or this use agreement.

  • 7.5 You agree that LOMI, at its sole discretion, may terminate your account or use of the Service (or any part of the Service) for any reason, including but not limited to lack of use, or if LOMI believes that you have violated this Agreement, and will Any content you make within the Service will be removed and deleted. You agree that the services provided in accordance with any provision of this Agreement may be interrupted or terminated without prior notice. You acknowledge and agree that LOMI may immediately close or cancel your account and delete all relevant information and files in your account, and/or prohibit the continued use of the aforementioned files or this service. 8. Guarantees and Guarantees

4) Any advice or information you obtain from LOMI or through this service, whether in written or oral form, will not constitute any guarantee other than this Agreement, unless expressly provided in this Agreement.

9. User behavior

  • 9.1 You should abide by relevant laws and regulations, and agree to take full responsibility for any behavior and results of using this service using your login account in any way. If your behavior violates national laws, you will bear all legal responsibilities in accordance with the law; if it is suspected of constituting a crime, the judicial authorities will hold you criminally responsible. LOMI will cooperate in strict accordance with its obligations under the law and the requirements of the judicial authorities.

    At the same time, if LOMI has reason to believe that any of your actions, including but not limited to any of your remarks or other actions, violates or may violate any provisions of national laws and regulations, LOMI may terminate the provision of services to you at any time without any prior notice.

  • 9.2 You agree not to use the Service to conduct any illegal or improper activities, including but not limited to the following:

    1) Publish or otherwise transmit information containing any of the following contents:

    • Opposing the basic principles established by the Constitution;
    • Endangering national security, leaking state secrets, subverting state power, and undermining national unity;
    • Damaging national honor and interests;
    • Inciting ethnic hatred, ethnic discrimination, and undermining ethnic unity;
    • Undermining national religious policies and promoting cults and feudal superstitions;
    • Spreading rumors, disrupting social order, and undermining social stability;
    • Spreading obscenity, pornography, gambling, violence, murder, terror or instigating crimes;
    • Insulting or slandering others and infringing upon others' legitimate rights;
    • Contains content that is false, fraudulent, harmful, threatening, invasive of another's privacy, harassing, infringing, defamatory, vulgar, obscene, or otherwise morally objectionable;
    • Contains other content restricted or prohibited by laws, regulations, (department) rules and any legally binding norms;
    • Contains content that LOMI deems inappropriate for display on LOMI;

    • 2) Endanger the legitimate rights and interests of others in any way;

    3) Impersonate any other person or institution, or falsely state or misrepresent your affiliation with any person or institution;

    4) Publish, email or otherwise know any content that you are aware of but do not have the right to transmit based on any legal, contractual or legal relationship (such as internal information, proprietary and confidential information learned or disclosed due to employment relationships and confidentiality contracts). Transmitted by other means;

    5) Publish or otherwise transmit content that infringes upon others’ copyrights, patent rights, trademark rights, trade secrets, or other exclusive rights (hereinafter referred to as “exclusive rights”);

    6) Publish, send or otherwise transmit any "advertising letters", "promotional materials", "spam", "spam letters", "chain letters", "direct marketing" or any other form of solicitation materials;

    7) Computer viruses (including but not limited to Trojan horses, worms, time bombs, cancelbots) designed to interfere with, destroy or limit the functionality of any computer software, hardware or communication equipment (below) Post, send or otherwise transmit any material (referred to as "viruses") or other computer code, files and programs;

    8) Interfere with or damage the Service or servers and networks connected to the Service, or violate any regulations, procedures, policies or norms regarding the network connected to the Service;

    10) Intentionally or unintentionally violate any applicable local and national laws, as well as any rules with legal effect;

    11) Intercept, tamper with, collect, store or delete your or others’ personal information, site emails or other data without legal authorization, or use such information for any illegal or improper purpose.

    You have acknowledged that LOMI does not have full control over users' usage behavior. When you use any content, including relying on the correctness, completeness or validity of the foregoing content, you agree to make your own judgment and bear all risks, without relying on LOMI. However, LOMI has the right to refuse and delete any content provided through this service that violates these Terms or is otherwise objectionable to LOMI at its own discretion.

  • 9.3 Any claims or requests made by any third party arising from or resulting from the content you provide, publish or transmit through the Service, your connection to the Service, your violation of this Agreement, or your infringement of any rights of others, including but not Limited to reasonable attorney fees and litigation costs, you agree to indemnify and hold harmless LOMI and its subsidiaries, affiliates, officers, agents, brand co-owners or other partners and employees from damage, and bear any liability arising therefrom.   • 9.4 You agree not to reproduce, copy, sell, resell or exploit for any other commercial purpose any portion of the Service, or use or access to the Service.

10. Intellectual property rights

  • 10.1 Intellectual property rights such as the content provided by LOMI in this service (including but not limited to web pages, interface designs, layout frames, text, audio, video, pictures or other materials, etc.) are owned by LOMI or related rights holders. Unless otherwise agreed, the copyright, patent rights and other intellectual property rights of the software, systems, etc. that LOMI relies on to provide this service belong to LOMI. LOMI.com, LOMI and other LOMI logos and product and service names are trademarks of LOMI. Without the prior written consent of LOMI, you may not delete, cover up or change LOMI's copyright statement, trademark or other rights statement, and you may not display or use LOMI's trademark in any way or otherwise process it, or represent that you have the right to display or use it. Or otherwise handle LOMI’s trademarks.

  • 10.2 The content you upload or publish on the LOMI website should be guaranteed to be the copyright owner or have obtained legal authorization, and the content will not infringe the legitimate rights and interests of any third party. By clicking to agree to this agreement, you agree to grant LOMI a non-exclusive license to use all the above-mentioned content. According to this license, LOMI will have the right to use the above-mentioned content in ways that are not prohibited by Chinese laws, such as display and promotion, and to protect you. For the purpose of personal information or privacy security, the above content will be signed as LOMI netizen. At the same time, you agree to allow LOMI to defend your rights against any subject that infringes upon your rights, depending on the specific circumstances, including but not limited to sending rights protection letters, filing lawsuits, applying for arbitration, etc., and its effect shall extend to any content protected by copyright law published by users on the LOMI website. Content, you can also authorize other third parties to protect your rights, and you can terminate the authorization to LOMI at any time.

  • 10.3 You have the right to authorize the content you publish on LOMI to be used by others. LOMI welcomes you to give priority to LOMI for cooperation on related content.

  • 10.4 You understand and agree that this service and related software used in this service contain proprietary and confidential information protected by relevant intellectual property rights and other laws. You also understand and agree that the content contained in sponsored advertisements or information presented to you through this service or advertisers is also protected by copyrights, trademark rights, patent rights or other exclusive rights. Without the express authorization of LOMI or advertisers, you may not modify, rent, lend, sell, distribute any part or all of this service or software, or create derivative works based on it, or use unauthorized modified software, etc. LOMI only grants you a personal, non-transferable and non-exclusive right to use its software on a single computer, but you shall not (and shall not allow any third party to) copy, modify, adapt, translate, Create derivative works, perform restoration engineering, reverse assembly, disseminate or otherwise discover the source code, or sell, transfer, sublicense or provide warranty for the software, or otherwise transfer any rights in the software. You agree to use the service through the interface provided by LOMI and not by any other means.

  • 10.5 If you violate the Universal Copyright Convention, Trademark Law, Patent Law, Anti-Unfair Competition Law and other laws and regulations related to intellectual property or the provisions of this Agreement, you shall be solely responsible for the damage caused to others (including LOMI). 11. User exclusive rights

  • 11.1 LOMI respects the legitimate rights and interests of others (including intellectual property rights, reputation rights, goodwill rights, etc.), and calls on you to also respect the legitimate rights and interests of others.

  • 11.2 If you violate the prohibitive provisions of laws and regulations or cause infringement on the legitimate rights and interests of others or the public interests, LOMI will delete specific content in accordance with the provisions of national laws and regulations, or in appropriate circumstances, in accordance with this Agreement or its relevant provisions. or terminate your use of your account.

  • 11.3 If you believe that your legitimate rights and interests have been infringed upon, please follow the guidelines to submit a complaint, and LOMI will handle it in accordance with the law.

12. Special notice for international use

You understand that the Internet has no borders and agree to abide by all local laws and regulations regarding online conduct and content. You specifically agree to comply with all applicable laws and regulations regarding the transmission of information exported from your country.

13. Terms of use for minors

If you are a minor user under the age of 13, before using LOMI's products or services, you should read this agreement under the supervision and guidance of your guardian, and after obtaining your guardian's consent to this agreement, use LOMI's products or services. For products or services, you and your guardians shall bear responsibilities in accordance with the laws and the provisions of this Agreement. If you are the guardian of a minor user, please read carefully and carefully choose whether to agree to this agreement.

14. General Terms

  • 14.1 LOMI’s failure to exercise or enforce any right or provision of this Agreement shall not constitute a waiver of the aforementioned rights or rights.

  • 14.2 The titles in this Agreement are for convenience only and have no legal or contractual effect.
